Abstract

The paper purports to analyze the question of political justice starting from the contribution of a classic on this subject: the book Political Justice by Otto Kirchheimer. The paper reconstructs the historical background of that book. By doing so, it shows how the background nurtured the critical reflection the book contains, and its implications for contemporary theoretical and historical investigations, which have put a particular stress on the political processes and functions of the courts (both constitutional and international criminal courts).
